1. Agreement to these Terms
By downloading, installing, accessing, or using LivingSteps, you agree to these Terms of Service ("Terms") and acknowledge the LivingSteps Privacy Policy. If you do not agree, do not use the app or website.
Additional Google Play, Android, device-manufacturer, advertising-provider, promotion, or third-party terms may apply to particular services. If you use LivingSteps on behalf of another person or organization, you represent that you have authority to accept these Terms for them.
2. Eligibility
You must be legally able to agree to these Terms. LivingSteps is not directed to children under 13, or under a higher minimum age where required by local law. If you are below the age of legal majority where you live, use LivingSteps only with permission and supervision from a parent or legal guardian.
Some advertising, promotional, or reward features may have separate age, country, device, account, identity, or other eligibility requirements.
3. Limited license
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use LivingSteps on Android devices that you own or control for personal, non-commercial purposes.
You may not copy, modify, distribute, sell, rent, lease, sublicense, reverse engineer, decompile, extract source code from, or create derivative works of LivingSteps except to the limited extent applicable law expressly permits despite this restriction.
4. App operation and availability
LivingSteps may offer step tracking, estimated activity metrics, goals, history, reminders, advertisements, and promotional or reward-related features. Features can differ by app version, device, operating system, country, permission setting, and provider availability.
We may add, change, limit, suspend, or discontinue any feature at any time for product, maintenance, security, abuse-prevention, business, or legal reasons. We do not guarantee uninterrupted availability or compatibility with every Android device, sensor, power-management setting, network, or third-party service.
5. Health and activity notice
LivingSteps is a general activity and habit-support tool. It is not a medical device and is not intended to diagnose, monitor, treat, cure, or prevent any disease or medical condition. It does not provide medical, fitness, financial, or other professional advice.
Steps, distance, calories, activity time, goals, and similar values are estimates. They may be incomplete or inaccurate because of sensor limitations, device placement, movement type, permissions, operating-system behavior, battery restrictions, or other factors. Do not rely on LivingSteps for medical decisions, emergency response, or safety-critical tracking. Consult a qualified professional before changing your activity routine if you have health concerns.
6. Points, promotions, and rewards
If LivingSteps offers points, badges, incentives, prize opportunities, redeemable benefits, or other rewards, those features are promotional and subject to the rules displayed with the relevant offer. Availability, eligibility, earning rates, limits, expiration, inventory, redemption methods, and value may vary by version, region, campaign, provider, and time.
- Steps, points, balances, and reward indicators are not bank deposits, wages, stored value, cryptocurrency, or legal tender.
- No reward has guaranteed cash value unless a specific offer expressly says otherwise and states its conditions.
- Rewards may be limited, substituted, delayed, corrected, canceled, or unavailable, including when inventory ends, a provider fails, an event is not verified, or law requires it.
- You may not sell, transfer, combine, automate, manipulate, or exploit points, accounts, devices, ad events, referrals, or qualifying activity.
- We may withhold or reverse points or rewards connected to suspected errors, duplicate events, invalid traffic, automation, tampering, fraud, policy violations, or chargebacks while we investigate.
Unless the specific offer states otherwise, you are responsible for any taxes, data charges, or other costs associated with participation or redemption. Contact support if you believe a balance or qualifying event was recorded incorrectly.
7. Advertising and third-party services
LivingSteps may contain banner, interstitial, native, or rewarded advertisements and links supplied by third parties. Advertising content is selected and delivered by advertising providers, not necessarily by us. We do not endorse or guarantee third-party products, claims, availability, websites, apps, or offers.
Your interactions with advertisers and third-party services are between you and those providers and may be governed by their own terms and privacy policies. We are not responsible for third-party content, transactions, outages, reward fulfillment, or data practices except to the extent required by law.
8. Acceptable use
You agree not to misuse LivingSteps or the website. You may not:
- Use the service in a way that violates law, infringes rights, deceives others, or causes harm.
- Falsify, simulate, automate, replay, or manipulate step activity, ad events, referrals, device data, eligibility, points, or reward claims.
- Use emulators, scripts, bots, click farms, modified clients, rooted-device tools, or multiple accounts or devices to obtain an improper advantage.
- Bypass permissions, eligibility rules, geographical restrictions, security controls, rate limits, or fraud-detection measures.
- Interfere with the app, website, servers, providers, advertising systems, or another person's use of the service.
- Attempt unauthorized access, probe for vulnerabilities, introduce harmful code, or extract non-public data.
- Use LivingSteps or its content for resale, unauthorized commercial activity, or development of a competing service.
9. Privacy
The LivingSteps Privacy Policy explains how information is handled when you use the app and website. By using LivingSteps, you acknowledge that policy and the privacy choices it describes.
10. Intellectual property
LivingSteps and its software, design, branding, text, graphics, and other content are owned by us or our licensors and are protected by intellectual-property laws. These Terms do not transfer ownership rights to you.
If you send feedback or suggestions, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use them without restriction or compensation, subject to applicable law and our Privacy Policy.
11. Suspension and termination
You may stop using LivingSteps at any time and can uninstall the app. We may limit, suspend, or terminate access to a feature, balance, promotion, or service if we reasonably believe you violated these Terms, created security or legal risk, manipulated qualifying activity, or engaged in fraud or abuse.
Upon termination, your license ends. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, dispute provisions, and accrued obligations—will continue to apply.
12. Disclaimers
To the maximum extent permitted by law, LivingSteps, its website, measurements, advertisements, promotions, rewards, and all related content are provided "as is" and "as available." We disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, title, non-infringement, security, availability, and uninterrupted or error-free operation.
We do not warrant that steps or other activity will always be detected, that any goal or reward will be earned, that an advertisement or offer will remain available, or that a third party will perform as expected.
13. Limitation of liability
To the maximum extent permitted by law, we and our affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, opportunities, points, rewards, or business, arising from or related to LivingSteps, even if advised that such loss may occur.
Some jurisdictions do not permit certain warranty disclaimers or liability limitations. In those jurisdictions, these provisions apply only to the extent permitted by law and do not limit rights that cannot legally be waived.
14. Responsibility for your conduct
To the extent permitted by law, you agree to be responsible for losses, claims, and reasonable costs resulting from your unlawful use of LivingSteps, your material violation of these Terms, or your infringement of another person's rights.
15. Governing law and disputes
These Terms are governed by the laws applicable where the LivingSteps developer is established, without regard to conflict-of-law rules, except where mandatory consumer law in your place of residence provides otherwise. Before filing a formal claim, please contact us and allow a reasonable opportunity to resolve the issue informally.
16. Changes to these Terms
We may update these Terms when LivingSteps, our providers, or legal requirements change. We will post revised Terms here and update the effective date. If a change is material, we may also provide an in-app notice or another notice where appropriate. Continued use after the revised Terms take effect means you accept them, unless applicable law requires a different form of consent.
